WANG Zhen-guo, JU Fang-ning, LV Jia-wei, SONG Yong-mei, ZHANG Feng-cong
2022, 23(6): 351-360.
Abstract:
Academic schools of Chinese medicine are one of the distinctive features in the development of Chinese medical academics. As the education model of Chinese medicine in higher education institutions is becoming more and more standardized and unified, the characteristics of academic schools are gradually fading, which affects the academic competition and innovation. In recent years, with the attention of our nation, the research and inheritance of academic schools of Chinese medicine has been prosperous and has shown distinctive characteristics of the times, and some academic achievements have emerged from various perspectives and methods of studying it. The creation and practice of new theories have become the engine of academic development of Chinese medicine. However, there are still some problems in its relevant research in terms of conceptual standardization, cultural interpretation, application of characteristic techniques, and construction of evaluation system. Thus, there is still a long way to go.

ZHENG Hong
2022, 23(6): 361-364.
Abstract:
In the micro-medium-macro perspective, the study of academic schools of Chinese medicine belongs to the medium level, which is more comprehensive than the study of distinguished doctors at the micro level, flexible and diverse compared with the basic theories at the macro level, and more closely related to practice. The perspective of the medium-range theory is conducive to rationalizing the differences in academic schools of Chinese medicine by paradigm, technique, style, and organization (region), and to analyzing in depth the relationship between theoretical unification and practice diversity.
The Origin of the Jinling Medical School: Centering on the Hereditary Doctors of Chinese Medicine in Nanjing
SHEN Jie, CHEN Ren-shou
2022, 23(6): 365-370.
Abstract:
Based on the local chronicles of Nanjing, related bibliography and ancient documents, the family chain of hereditary doctors in Nanjing was sorted out, and it was concluded that the origin of the Jinling medical school was closely related to the heritage of hereditary doctors in Nanjing. Thus, hereditary doctors were an important cornerstone of its formation and characteristic development. It is also suggested that Nanjing's hereditary medical practice was characterized by a large number of immigrants, and doctors influenced by Confucianism, with inclusive, practical and innovative academic attitudes, while the genealogy of hereditary medicine is not clear, and the medical writings are seriously scattered. In conclusion, the above characteristics have an important influence on the formation of the Jinling medical school.

HE Zhong-jun, JIANG Hua, WANG Li
2022, 23(6): 371-379.
Abstract:
Based on the previous research achievements on the Sichuan Chinese medical school, its academic characteristics are summarized, reflected, and condensed considering Sichuan as one of the "origins of Chinese medicine" and "reservoirs of Chinese materia medica". Besides, some new understandings about it are proposed. The formation of its academic characteristics is based on the complex geographical environment of Bashu, combined with the historical culture of Bashu with a local and immigrant cultural integration. Thus, it is fused in the academic exchanges between Chinese medical physicians inside and outside Sichuan. The academic characteristics of the Sichuan Chinese medical school are listed as follows: having a compatible attitude with a long history, having an innovative and pioneering spirit, as well as having inclusive and colorful cultural deposits. The above characteristics are manifested in diversified academic aspects, such as the combination of acrid and sweet medicinals, and good use of medicine with a hot or warm nature and acupuncture. The characteristics of the Sichuan school of Chinese materia medica include enjoying genuine regional medicinals with great yields and varieties, good at both medical practicing and formula prescribing, and putting emphasis on "treatment effects" and clinical practice.

Exploration on the Cultural Roots of "Yang in Excess with Insufficient Yin"
DUAN Ze-hua, JIA Cheng-xiang
2022, 23(6): 385-388.
Abstract:
The theory of "yang in excess with insufficient yin" is not just closely related to Zhu Dan-xi's study experience and medical practice, but is also inextricably linked to the social background, the theory in Huangdi's cannon of medicine, the ideology of "Yijing", as well as the academic influence of Song and Yuan dynasties. By exploring the connotation of the theory of "yang in excess with insufficient yin", and by considering the background of the time when Zhu Dan-xi proposed it, we can sort out the cultural context and explore the cultural roots, which will be beneficial to the understanding of Zhu Dan-xi's medical thought.
Identification of "Major Diseases" in Revocable Marriage System
ZHANG Rong, XIE Qing-yun
2022, 23(6): 389-395.
Abstract:
The Civil Code added a new cause of marriage cancellation, "concealing major diseases", to the revocable marriage system. The Civil Code did not clearly define the connotation of "major diseases", which has caused divergence in understanding between the academic and judicial circles. Through the analysis of the legislative evolution, it indicated that the provisions on diseases in marriage have gone through the process from public interest to personal interest. Major diseases included in the revocable marriage system reflects the importance of legislation on personal interests. Therefore, major diseases should be understood from the perspective of personal will. However, this does not mean that personal will is the only basis for identifying major diseases. Whether it refers to a major disease still needs to take into account the interests of the weak in the marriage and family relationship. In essence, this is a process of interest game, and the identification of major diseases needs to balance different interests. Thus, the definition of major diseases should be based on whether the damage to the interests of the concealed party caused by the disease is higher than that of the weak in the marriage and family relationship caused by the dissolution of the marriage. If it is higher, the court can regard the disease claimed by the concealed party as a major disease.
Research on the "Legitimate Imbalance" State Between Public and Private Rights In the Context of Corona Virus Disease 2019
WANG Yu, LIU Na
2022, 23(6): 396-402.
Abstract:
The state of "proper imbalance" between public power and private power refers to the special state of relative imbalance between the powers accompanied by the promulgating and implementing of various emergent laws and policies. The public and private rights in this state are different from the normal, which are presented as the reasonable expansion of public rights and the appropriate restriction of private rights. This special state is the right state to deal with public emergencies, characterized by rationality and legitimacy. In the context of the prevention and control of Corona Virus Disease 2019, the main purpose of this state is to ensure the life, health and safety of citizens. Medical institutions are directly related to citizens' life, health and safety. Solving the problems faced by medical institutions is the key to further realizing the purpose of "legitimate imbalance" and maintaining its legitimacy. Through the analysis of policies and related accidents, it is considered that the most urgent problem faced by medical institutions is that there is a phenomenon that it is difficult to abide by the law when they undertake the epidemic prevention function. In this regard, it is proposed to solve problems from three ways: medical institution measures, government actions and legal regulation.
Construction of Relief System for Adverse Reactions of Traditional Chinese Medicine Injections in China
DONG Zhi-jie, YAO Zheng-rong
2022, 23(6): 403-409.
Abstract:
The traditional Chinese medicine (TCM) injection is a new dosage form independently developed in China, which breaks through the traditional way of administration and plays a vital role in modern medical practice. However, the frequent occurrences of adverse reactions of TCM injections have aroused widespread concern. If the adverse reaction events of TCM injection cause serious damage to the patient, the relevant subject shall compensate the victims. However, based on the realistic dilemma such as controversial defect identification, undefined principle of liability fixation, and unestablished relief mechanism has not yet been established, there is defectiveness of the current legal relief in practical operation and it cannot provide effective relief to victims. By drawing on the successful experience of foreign adverse reaction relief systems combined with China's specific national conditions, it is suggested to improve the interpretation standards of drug defects, clarify the responsibility attribution in the adverse reactions of TCM injections, establish a special compensation fund, strengthen the governance and supervision of the fund link, as well as establish a compensation system for the adverse reactions of TCM injections mainly based on the fund model.

HAN Kai-li, GUO Gang
2022, 23(6): 415-420.
Abstract:
College students' recognition of traditional Chinese medicine (TCM) culture affects the depth and breadth of the development of TCM culture. This paper investigated the cultural identity of TCM college and university students in many non-TCM colleges and universities across the country in the form of questionnaires and interviews. The obtained data was analyzed in terms of reliability, validity, correlation, as well as applied to make a differentiation analysis on the cognitive level, emotional dimension and behavior of college students in view of TCM culture. The results of questionnaire and interview showed that non-TCM college students did not know much about the basic knowledge of TCM culture, but they had high enthusiasm for emotional identification and behavior implementation of TCM culture. Through the help of non TCM colleges and universities, TCM research institutions and the state, non-TCM college students can improve their TCM cultural awareness, further improve their TCM cultural identity, and then strengthen their cultural self-confidence.
