Ethical Review and Legal Regulation of Social Egg Freezing Technology in the Era of Low Birth and Aging Population

With the deepening of the aging population with fewer children in our country, based on considerations of social public interests and population security, the government has to intervene in the "private sphere" of individual fertility through the use of population policies as a "public power". However, the transformation of modern female reproductive concepts and the popularization of high education have led to an increasing number of single women hoping to achieve their fertility through egg freezing technology. This phenomenon has sparked ethical and legal considerations among the public regarding the application of social egg freezing technology. At present, China still adopts a prohibitive attitude towards social egg freezing technology, and there are legal issues such as paternalism, illegal use of technology, health and safety risks, and debates on bioethics. However, in order to effectively deal with the dual dilemma of aging society with fewer children and female reproductive pressure, it is suggested that on the basis of providing legitimate rights for social frozen eggs such as reproductive rights and body rights, moderately lift the ban on social frozen eggs technology and improve the supporting service mechanism, clarify the subject access qualifications and disposal procedures of remaining frozen eggs, strictly standardize the whole process of diagnosis and treatment of medical institutions and medical personnel, so as to ensure that the use of frozen eggs technology within the legal limit to strengthen the construction of fertility preservation system, and strive to solve the problem of imbalance in China's population structure and fertility difficulties.
