JIA Cheng-xiang
2023, 24(1): 1-7. doi: 10.20060/j.cnki.ISSN1009-3222.2023.0001
Abstract:
One can give one's own interpretation of the mysterious Tao based on intuition, thus greatly enriching the extension of the Tao, but the core content of the Tao is beyond anyone's grasp and expression, which means that an individual as a human being has the role of promoting and enhancing ideas, values, and cultural spirit. Zhang Zhong-jing is known as the "saint of medicine" and his work is known as the "origin of prescription books", so his academic thinking must contain the spirit of humanity. Through organizing the literature on Zhang Zhong-jing's himself, events, and works, this study aims to discover the cultural spirit contained in his scholarship and promote it, so that those who study the scholarship of Zhang Zhong-jing can also understand his core ideas.

LI Jian
2023, 24(1): 8-16. doi: 10.20060/j.cnki.ISSN1009-3222.2023.0008
Abstract:
In the first half of the 20th century, western-style hospitals embedded in China's medical landscape gradually gained widespread acceptance by the government and the public, while the space for the practice of Chinese medicine was squeezed. As one of the main measures to improve the work of Chinese medicine, the process of "introducing Chinese medicine into hospitals" in the 1950s would be naturally accompanied by conflict and resistance. After several years of conflict and adaptation, the "introduction of Chinese medicine into hospitals" spread from point to plane, and newly-built Chinese medical hospitals and the establishment of Chinese medical departments in general hospitals became the main methods of "introducing Chinese medicine into hospitals" in new China. The "scientification" of Chinese medical treatment activities became the inevitable result.

Drug Legislation and Strife of Interest——the Making and Amendment of Rules for the Prepared Drugs Administration by the Nanjing National Government
DONG Zhi-peng
2023, 24(1): 22-30. doi: 10.20060/j.cnki.ISSN1009-3222.2023.0022
Abstract:
In the Republican period, health service was gradually incorporated into the national legal system, and the Nanjing national government formulated the Rules for the prepared drugs administration to establish a dual management system of centralized laboratory testing and parallel registration by local authorities, and to rectify and regulate the prepared drug market. The formulation of this rule was affected by the political disputes among factions and the controversy over the abolition of Chinese medicine. Besides, the introduction of the rule caused many contradictions due to technical errors in the legislation itself and the enforcement of the law that touched on the interests of many parties, which made the implementation of the rule ineffective. In order to solve the problem of the prepared drug administration, the health department of the national government and the pharmaceutical companies have repeatedly communicated with each other, re-organized the general registration of the prepared drug, simplified its registration procedures, and substantially amended the Rules for the prepared drugs administration, partially satisfying the demands of pharmaceutical companies and reducing the interests of local authorities. The evolution of the rules shows the twists and turns in the formulation and implementation of special regulations in the game of interests in a specific historical period.

DAI Jun-tong, ZHOU Yang
2023, 24(1): 31-36. doi: 10.20060/j.cnki.ISSN1009-3222.2023.0031
Abstract:
The Comprehensive recording of divine assistance: Pediatric chapter is a collection of the great works of pediatric medicine before the Northern Song dynasty. Through studying the Pediatric chapter, we find that the dosage of prescriptions for children is closely related to the disease, medicine nature as well as age, and another important factor is the dosage form of the prescription. The number of dosage forms in the Pediatric chapter was further enriched than that of the previous generation, with 31 types, of which the most used were pills and powder. The variety of dosage forms provides the possibility of refining the dosage of prescriptions for children. In line with the dosage form, the unit of measurement of prescription dosage also shows the characteristics of visualization and diversification. In addition to metric units, many analog quantity units were also used, including 19 kinds for pills. The study of the dosage of prescriptions in the Pediatric chapter is beneficial to the study of the dose-effect relationship of prescriptions for children, which is of certain significance to the modern clinical use and dosage of prescriptions for children, and also has certain value to enrich the literature of prescription studies.

Research on the Patent Challenge System of Generic Drug in China
LI Jian
2023, 24(1): 45-53. doi: 10.20060/j.cnki.ISSN1009-3222.2023.0045
Abstract:
China's current patent legal system has initiated the patent challenge system of generic drug, which has become the core component of the early resolution system of patent disputes between generic drug companies and original drug companies. China's patent challenge system includes the invalidation announcement incentive system and the administrative and judicial "dual track" relief mechanism. This system not only embodies the design concept of the unity of innovation incentive and respect for human rights, but also has the value implication of correcting justice and optimizing efficiency. However, as for the notification system and compensation system for indiscriminate litigation, there are some problems such as lack of supervision mechanism and unclear application conditions, which make the system remain greater operational risks. In terms of future amendments to relevant laws, it is suggested to complete the patent challenge notification system and limit the identification standard of "subjective malice" in indiscriminate litigation compensation, so as to achieve the balance of multiple interests among generic drug enterprises, original drug research enterprises and the public.
An Empirical Study on the Compensation System for Vaccination Damage in China
ZHANG Yu, ZHOU Bin-bin
2023, 24(1): 54-62. doi: 10.20060/j.cnki.ISSN1009-3222.2023.0054
Abstract:
In terms of the problem of vaccination damage, China has currently provided two relief paths. For abnormal reactions of vaccination, administrative compensation system is applicable, while for non abnormal reactions, civil infringement can be applied to obtain compensation. However, as for the civil compensation system, through the statistical analysis of judicial cases, it can be found that there are many defects in its practical application, such as poor connection with the administrative relief system, difficult identification of causality, unreasonable distribution of burden of proof, and different compensation standards for mental damage. Therefore, it is necessary to further improve the vaccination damage compensation system, and put forward improvement suggestions on the existing problems, so as to enable the injured party to receive adequate relief, thus building a good medical order in China.

LI Jia-xin, TIAN Kan, YU Xiao-yong
2023, 24(1): 63-70. doi: 10.20060/j.cnki.ISSN1009-3222.2023.0063
Abstract:
Based on the dynamic monitoring survey data of the national floating population in 2017, the impact of social isolation on the residence intention of the elderly floating population was analyzed. First of all, the application of binary Logistic regression showed that social isolation has a negative impact on the residence intention of the elderly floating population, and the control variables such as age, education level, registered residence nature, job, self-purchased house, mobility scope and mobility time also affected the residence intention of the elderly floating population. Secondly, the propensity score matching method was used for robustness test, which further proved that the negative impact of social isolation on the residence intention of the elderly floating population was stable. Finally, the paper discussed the influence mechanism of the intermediary variable of the sense of urban belonging between social isolation and residence intention. In order to improve the residence intention of the elderly floating population, the following suggestions were put forward: expanding the social network of the elderly floating population so as to reduce the occurrence of social isolation, paying attention to the registered residence and housing needs of the elderly floating population to provide equal opportunities and security, along with improving the sense of urban belonging of the elderly floating population for achieving subjective identity.
