预先医疗指示咨询的含义、伦理价值和法律因应

摘要: 预先医疗指示咨询是患者在有决定能力时，与医护人员及家属讨论临终医护方式的持续沟通与讨论的过程。预先医疗指示不应该仅仅被视为一项法律文件的签署，作为过程的预先医疗指示咨询在医疗实践中同样具有诸多伦理价值。但是，在对预先医疗指示进行立法时，还应考虑预先医疗指示的使用率与被执行率之间的关系，建议在法律中不必将咨询规定为订立预先医疗指示的强制前置程序，但不妨将咨询作为鼓励性规定。
